In the course of operations, enterprises sometimes lend or rent out domains for which they have already completed filing to others, in order to save trouble or spread costs. This practice may look like mere resource allocation, but it actually carries considerable risk. This article offers only a general risk reminder; the determination of specific situations should be based on the regulations and opinions of the competent authorities.

Filing information corresponds to the entity

When a domain is filed, a specific entity and its information are registered. Keeping the filing information consistent with the entity using it is a basic requirement of this system. If a filed domain is handed over to others for use, the actual user and the filing entity become separated, and this inconsistency itself may cause problems. It should be noted that lending or renting out a filed domain is not simply "lending a web address"; it relates to the requirements of real-name management and the traceability of online identity.

Two types of risk that may arise

The first is liability risk. While a domain is used by others, if illegal or non-compliant content or behavior appears, the filing entity often cannot fully extricate itself and may face corresponding management responsibility. The second is business risk. If control of the domain is not in your own hands, then once the user encounters a dispute, is attacked, or suddenly ceases operations, the business relying on that domain will be directly affected. Both types of risk are directly related to "the domain not being under your own control."

The proper approach: manage your own domains well

A more prudent approach is to manage domains as corporate digital assets. First, adhere to the principle of own use: each business segment should use an independent domain filed by the company itself, and domains should not be lent, rented out, or shared with others. Second, carry out full-lifecycle management: from registration, filing, and resolution to cancellation, every step should have records and a person responsible, to avoid domain expiration or cybersquatting. Third, when multiple regions and businesses are involved, plan domain registration and compliance arrangements in advance, rather than looking for one only when it is needed.

Bring domains into overall planning

Domain management may seem like a technical detail, but it actually concerns a company's online identity and business continuity. Rather than remedying things after a problem occurs, it is better to include it in consideration at the planning stage, clarifying who is responsible, how it is managed, and how problems are handled. Doing the basics solidly is the most practical way for an enterprise to avoid risks in the process of digitalization.
